1. Definitions
“The Company” refers to The Pest Guys (Pty) Ltd, its technicians, representatives, and staff.
“The Client” refers to any person, business, or entity that contracts the Company for pest control services.
“Services” refer to any pest management, treatment, monitoring, or inspection work provided by the Company.
2. Scope of Services
The Company shall render pest control services in accordance with the terms outlined in the service agreement, quotation, job card, or any treatment mutually agreed upon, whether in writing or verbally.
Services include treatment, prevention, and/or monitoring of pest infestations using approved products and methods.
The Company reserves the right to adjust treatment plans based on site inspection findings and safety considerations.
3. Client Responsibilities
The Client agrees to:
- Provide full access to the treatment area on the scheduled date and time.
- Follow all preparation and post-treatment instructions.
- Inform the Company in advance of:
  - Pets, children, or persons with chemical sensitivities on-site
  - Allergies or respiratory conditions
- Maintain hygiene and sanitation to support the effectiveness of treatment.
4. Service Limitations
Pest control is a process, not a one-time cure. Some infestations may require multiple treatments or maintenance plans.
The Company does not guarantee results where:
- Infestations are extreme or recurring
- Hygiene or structural issues persist
- Clients fail to follow recommendations
The Company will not be held responsible for re-infestation due to external factors beyond its control.
5. Warranties / Guarantees
Certain services may include a warranty (e.g., for rodents or termites), which will be specified in writing.
Warranties will be void if:
- The Client does not allow scheduled follow-up visits
- The structure is altered after treatment (e.g., building works, painting)
- Hygiene, proofing, or exclusion measures are ignored
6. Payment Terms
All invoices are payable as per agreed terms on the invoice.
The Company reserves the right to:
- Charge interest on overdue accounts (as per the National Credit Act)
- Suspend services for non-payment
The Client remains liable for full payment once services have been rendered, even if pest activity persists.
7. Cancellations and Rescheduling
At least 24 hours’ notice is required to cancel or reschedule a service.
A cancellation fee may apply for late cancellations or no-shows.
The Company may reschedule services due to weather, safety, or technician availability.
8. Use of Pesticides and Safety
All pesticides and pest control products used are registered with the Department of Agriculture, Forestry and Fisheries (DAFF) and comply with Act 36 of 1947.
Products are applied by trained, registered technicians in accordance with the Pest Control Operators Association of South Africa (PCO) code of conduct.
The Client must follow re-entry times, ventilation, and safety guidelines after treatment.
9. Limitation of Liability
The Company takes all reasonable care to ensure effective and safe service.
However, it shall not be liable for:
- Pre-existing damage or infestations
- Damage caused by incorrect client preparation or non-compliance
- Indirect, incidental, or consequential loss of any kind
Liability is limited to the amount paid by the Client for the affected service.
10. Indemnity
The Client hereby indemnifies The Pest Guys (Pty) Ltd against any claims, losses, or damages arising from:
- Non-compliance with safety instructions
- Failure to disclose allergies or property issues
- Acts or omissions by third parties after treatment
11. Confidentiality and Data Protection
The Company respects Client confidentiality and complies with POPIA (Protection of Personal Information Act).
Client details will be used solely for service provision, billing, and record-keeping.
No personal information will be sold or shared without consent, except as required by law.
12. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by the laws of the Republic of South Africa.
13. Amendments
The Company may update these Terms and Conditions at any time.
The latest version will be available on request or on our website.
